Chuck Rettig Adds Insights to Bloomberg Tax Article

In an article published in Bloomberg Tax on July 25, 2024, Former IRS Commissioner and Shareholder Chuck Rettig added his insight among a roundup of sources on the IRS denying employee retention credit claims and how businesses should navigate appeals. The article outlines that a number of new IRS letters denying pandemic-era tax credit claims are beginning to reach businesses, which is forcing them to go through the lengthy appeals process or sue the agency. The author also notes that the process to dispute ERC credit claims do not appear to be universal.

“Former IRS Commissioner Chuck Rettig said businesses also should consider submitting a Freedom of Information Act request for the entire administrative file for their claim and denial, including all related electronic communication,” explains the article. “Rettig is a shareholder at the firm Chamberlain Hrdlicka, which has seen ‘tons’ of these letters.”

“The small business community and the smaller claims must have a path forward,” said Rettig. “And that’s Appeals.”
